2. Recitals.

2.1. - The following conditions constitute the General Conditions for the use of the domain http://www.abocashop.com (hereinafter, for the sake of brevity, “General Conditions” and “Domain”, respectively), which shall be binding upon whosoever intends to view the contents thereof. Access to the Domain, and any operation involving the visualisation of its contents, constitute acceptance of the General Conditions; in the event that the user does not wish to accept the General Conditions, all he/she has to do is to refrain from navigating on the pages of the above website.

2.1.1. - Should a clause in the present General Conditions be deemed null and void, or invalid for whatever reason, then said clause shall be considered separable from the other clauses, and as such not having any impact on the validity or effect of the remaining conditions. 

2.2. - The User, when accessing the domain, tacitly agrees not to use the said domain and its contents for unlawful purposes, or in any case for purposes that are against the existing provisions of the law. The present General Conditions may be modified by Aboca S.p.A. Società Agricola at any time without prior warning to users, without prejudice to the users’ obligation to regularly consult the said General Conditions prior to accessing the contents of the Website. Viewing the domain following the aforementioned modifications implies full, unconditional acceptance of the thus modified General Conditions.

2.3. - Should goods and services be offered on the domain, or contents be presented there, at special terms and conditions indicated alongside the said services or contents, then these terms and conditions shall prevail over the present General Conditions.

3. - Copyright.

3.1. - It is forbidden to extract or re-utilise in any way the material present on the Domain, or to do anything else that may prejudice the name, reputation or lawful interests of the writers or of the holders of rights over the inventions situated therein, unless such is expressly authorised.

3.2. -None of the contents of the Domain may be copied, reproduced, republished, uploaded, transcribed, transmitted or divulged, either partly or wholly, through communication channels such as the internet, TV or radio channels, or any other such channel, in any way or form, without the prior written authorisation of Aboca S.p.A. Società Agricola, with the exception of those operations consisting in the printing, downloading and viewing of said contents for purely personal, non-commercial purposes, provided that the material in question is not modified in any way, and that all the information regarding intellectual and/or industrial property rights set out therein is preserved as such.

3.3. - The Domain and its contents may only be used for personal reasons, research or teaching purposes, and for no other purposes, provided that the name of the holder of the right remains unchanged; for the mere sake of example, the contents of the Domain means: (a) all graphical figures and/or text in general; (b) all forms of audio broadcast; (c) cartoons and other drawings; (d) wording; (e) data bases; (f) computer programmes; (g) photographs; (h) film clips; (i) graphs and tables; (j) slogans. The information contained in the Domain may not be used for commercial purposes in order to set up data bases of any kind, nor may it be stored (either partly or wholly) in existing databases, whether access to such is granted exclusively to the creator thereof, or whether they are made available to third parties. 


3.4. - All trademarks, domain names, company names, companies or signs present on the Domain are the exclusive property of Aboca S.p.A. Società Agricola, and thus protected by the provisions of the law governing distinguishing marks. Likewise, it is strictly forbidden to reproduce such marks in any way or form, without the express written permission of  Aboca S.p.A. Società Agricola, and it is also strictly forbidden  to register the “ABOCA S.P.A. SOCIETÀ AGRICOLA” trademark in any top level domain; the trademarks, names and domains, company names, companies and signs owned by third parties with whom Aboca S.p.A. Società Agricola cooperates in one form or another, shall enjoy exactly the same degree of protection afforded to the distinguishing marks of Aboca S.p.A. Società Agricola by the due laws in force. It is also strictly forbidden to use any distinguishing marks owned byAboca S.p.A. Società Agricola as metatags, and/or any commands in html which, although not resulting in the visualisation or formatting of a given command, provide instructions and/or information to the other logical entities present on the web.

3.5. - Without prior written agreement from Aboca S.p.A. Società Agricola, no links may be created to the home page of the Domain presently accessible at the URL http://www.abocashop.com/ (hereinafter also referred to as the “Home Page”), or to any other pages within the Domain. In order to apply for permission to do so, send an e-mail to museum@aboca.it, specifying: (a). -details of the persons in charge of the Domain (including their e-mail addresses and telephone numbers); (b). -the applicant’s personal details; (c). - the web address (URL) of the domain where the said link is to be created; (d). - any other information deemed of use for the purpose of obtaining permission from Aboca S.p.A. Società Agricola.

3.6. - Any specific links that enable the user to be sent to an internal page without having to go via the Home Page (“deep linking”) is strictly forbidden, and will be prosecuted as an act of unfair competition; similarly, automatic inclusion links (“inline linking”) enabling the user to automatically view images from the website in a special space, are also forbidden, as are “framing” links that enable the user to view a page from the Domain on a specific page of another domain, whereby the contents of said page, rather than appearing in a separate window of the browser, appear inside a frame specifically created for this purpose.

4. Exclusion of warranty and limits of liability.

4.1. - All of the contents published on the Domain are provided for general information purposes only. Aboca S.p.A. Società Agricola does not provide any guarantee of their accuracy or completeness, and reserves the right to modify and update said information without any prior warning. Aboca S.p.A. Società Agricola shall not be held liable for any loss, either direct or direct, including any loss of earnings, resulting from the use, or the impossibility of using, the Domain and its contents, or any websites directly or indirectly connected to said Domain, or resulting from any omissions or errors.

5. Jurisdiction and competent court of law.

5.1. - Without prejudice to any rights that the users enjoy in virtue of various national and international laws, the present General Conditions shall be governed by Italian law, and shall be interpreted in the light of that same law (with the exception of its rules on conflicts of law), including any disputes concerning the existence, validity or effect of the General Conditions, and any other agreements making reference to said General Conditions. Within the above limits, the court of law with jurisdiction over any disputes arising in relation to the present General Conditions, and in relation to any other agreements pertaining to said General Conditions, shall be the Court of Arezzo.
5.2. - In virtue of the application of Italian law, in the event of any differences in interpretation between the Italian and English versions of the present General Conditions, the Italian version shall prevail.
